Castilla y Leon - Spain - Regulation on the exercise by the Mediation

Adoptees can ask for help to find their biological parents

* is the first region where one can obtain this right.
* There is already a rule governing who can mediate and advise.

Adoptees in Castile and Leon are the first in Spain can now exercise their right to locate and find their biological parents.

This option is available after the Board give final step yesterday and to issue an order to show how professionals should act engaged in mediation and advice and who can engage in this work.

Since 2005, citizens of Castilla y León, higher of age, who had been adopted had the right to know their biological parents.

However, until today was very difficult, if not impossible, since there was no entity able to pursue professional or to seek out and mediate between the adoptee and their biological parents. Six petitions

3 years

In fact, three years six people have inquired about its origins and they have had to make across the board, with consequent difficulties for the lack of professionals trained in this work. The order regulates

two services for domestic adoptions, counseling and mediation, while for international only marked for guidelines to assess, as there are many different regulations in the countries from which comes the boy.

As professionals who can play the mediation are psychologists, pedagogues and social workers. The advice is in the legal profession. Everybody should have work experience of at least three years.

0667 - Spain - Mediation in 0665 The University

Granada University is preparing a cabinet to resolve conflicts.

The clash between two professors at the University of Granada, Luis García Montero and Jose Antonio Fortes, "the statement condemning the former for injuries and the consequences of this jumped to information in the past week. A and no more. At least that is what it claims the University of Granada (UGR) that works to create a cabinet whose end will mediation resolve conflicts both internally and discussed. Already done so successfully pioneered the Complutense University, which currently has the Complutense Institute for Mediation and Conflict Management (Imedia). Creating a similar body is one of the commitments contained in the agenda of the current government of the UGR. And there have been some steps.

The work began after the inauguration of the rector, Francisco González Lodeiro, who recently has seen the entrenchment of what your day would be a minor conflict has finally settled in justice and is mirrored by output UGR, at least temporarily, the Professor of English Literature Luis García Montero, who asked for a leave of absence next year.

His attempts to avoid it will be in vain, in light of the statement by the poet who believes that there is in the Department an appropriate environment so preferred time away from teaching. "The Cabinet of mediation would have been the appropriate forum to address the issue, but the issue has been escalating, has had a very wide path and has become entrenched," laments the inspector's services UGR, Luis Megías.

encysts precisely at the university level. But he ruled out with important consequences for the image of the University, although the conflict between members of this community are not unique to Granada. Is difficult to tell if you have been running this cabinet had resolved the situation differently. In any case, the intention is that it does not recur.

Therefore, the UGR is working on several fronts to train future mediators, who need a graduate and intervene at the request of the parties involved in agreement and in the field of Inspection Services, which run from the next Council Government on the internal rules that will help better regulate the service and make it known. The horizon for its creation will depend on the training of mediators which shall likely future world of law and psychology, but must have a "personal aptitudes." If the parties in conflict decide, on a voluntary basis, submit to mediation must sign a contract, explains Megías, with which they agree not to use information outside of that context.

The result of the action in some way linked to the Inspectorate, the University Ombudsman and the very UGR. In fact, currently in Andalusian universities conflict can occur only go to the University Ombudsman. There is still in the mediation community as a cabinet which aims to create Granada to have an internal system of cooperative management of conflict.

Preventive work started months ago and is an example of this is the day of awareness to the mediation that was organized last June led the government team of the UGR. There realized the Complutense experience, which began in 2004 and the various aspects of mediation between universities. The goal is that everyone knows the importance of mediation.

this future cabinet, which expected the mediators will work with a kind of shift system and if it capable of mediating a case will be assigned to that touch, are called students and teachers who have a problem with another student or or with a teacher or peer educators. "Obviously when a conflict is resolved in the field of mediation is better than in the disciplinary" adds Megías. The

Granada University Ombudsman in the coming years will be Enrique Hita, newly elected, but has not yet taken office. In his choice last week and was in favor of resolving conflicts within this academic field, provided these are not strictly disciplinary matters in which the Inspectorate has to act on its own. PGJE Coahuila on new law enables

The certification course is intended for all prosecutors, and thus it is intended that the officials have more alternative solutions for disputes.

In order that the elements of the Office of Justice as judges and lawyers know the legal reforms which will be operating, the PGJE implemented a certification course for all Public prosecutors since the new law removes the secretary becomes a lawyer and social representative.

data dependence, down so far been trained to eight groups that have been given the course of this new law, the solution of alternative measures, the controversies and twenty people missing dependency to know the new scheme of it.

is regulated in a specific way, situations that were previously at the discretion of prosecutors and gives greater transparency in the integration of the preliminary investigation, "is unnecessary trials lasting up to two years ending with a sentence of fine," he said.

With the new tools are just looking to reduce levels of impunity that loopholes are not allowed to abate, because these reforms are aimed to abate this situation presented by the delay in resolving cases and the heavy workload that is presented.

0656 Minorca - Spain - Day of Mediation

"Today we hold less in need partners because they hold"
José Pascual Ortuño, director general of law de Catalunya, understands the social mediator as an enhancer of dialogue among conflicting parties

If there is an authoritative voice to speak of social mediation, this is the José Pascual Ortuño. Currently CEO of Law and Legal Entities of the Generalitat de Catalunya, is one of the pioneers of this method of conflict resolution .

- If family mediation is becoming more, does that mean that the dialogue in families will increasingly less?

- The relationships today are very different from those I had previously. Now relations are much more sincere, and when they break is a different way. Previously there was a mattress that was an extended family, interests, and it was normal, although that would break the relationship, the couple remained together displaying a great hypocrisy. Today we have more capacity for dialogue, a capacity that did not exist.

- The elderly couples say they now endure less ...

- that can withstand not less. The woman has been released, since before his life was subject to man, and when she married was not going back. Put up with cars and carts, and many are not separated because they had no economic potential. It is no longer the case. So if the relationship today is not satisfactory, there is much more likely to break. And that's not bad. Not hold because there is no need endure. There is also a cultural factor. If a person has a different trend from that of your partner, it is logical to seek a more satisfying relationship with another partner.

- Here we go a little late on the issue of separation of couples ...

- Yes

- Is the burden of dictatorship?

- not only the dictatorship, is common in many Mediterranean countries. It is a conception of the family very own archaic Catholicism. But regardless of ideology and religion, mediation is almost always appropriate. In fact, mediation is recommended from the field of medicine.

- Medicine recommends mediation?

- The first mediation center in Barcelona has emerged in the Hospital de Sant Pau. Mediation is very close to health.

- When should a mediation?

- A large percentage of breaks in which the two sides have a good relationship and are able to reach agreement by themselves. Mediation is indicated when there is conflict, and where there are children. In this case it is almost essential. In contrast, in cases of violence, alcoholism or drug addiction, mediation is almost useless, as is when no children or interests. Mediation, in short, is appropriate if the parties have to maintain a relationship over time.

- What is the key to a good mediator?

- Do not attempt to provide solutions. The mediator must be a great communicator and analyzer of the conflict. Einstein said that there is no unsolvable problems, but ill-defined problems. The mediator will have to do is raise the problem well. The mediator must find the iceberg that lies behind the breakup of a relationship. When the parties are able to see the reality of the conflict, they are the ones who see the solution.

- In Catalonia, mediation is very successful. Is proving to be a very effective tool.

- A measure to be put into practice, many fears disappear into this method. It is starting to see the usefulness of this tool by all sectors of society: lawyers, psychologists ...

- With this proven, appears when the time comes to extend the method, and this requires that the government's drive. Do you give the government the importance it deserves mediation?

- Yes, a change in methodology is not easy. Furthermore, there is trained mediators, and if we tried to implement the mediation by a decree we find no specialists. A European directive and urged to implement mediation in the coming years, and besides, all the autonomous regions have begun to work in mediation, regardless of political color. In Islands, for instance, began a government team of one color, and when it changed, the project goes ahead. Therefore, mediation does not belong to a particular ideology, but it is generally accepted.

Consell law encourages mediation to expedite the resolution of family disputes

This Directive represents further progress in the field extrajudicial dispute resolution, after the so-called Green Paper prepared by the Commission in April 2002, which already raised the mediation as an alternative to the best resolution of disputes.

The objective pursued right now is to create in all Member States an effective mechanism to control the mediation services, and at the same time ensuring the flexibility and autonomy of the parties, so that they can achieve agreements to resolve their conflicts and that these, if any, can be also executed. This, from the strictest confidence that should govern this type of process, and without prejudice to the parties concerned, in the absence of such agreements, they may resort to litigation or arbitration to defend their interests without detracting from them.

To do so, the directive calls on Member States to promote mediation in all its orders, especially in the court, promoting initial and continuing training of mediators and specialized agencies, and develop codes of conduct to serve as guidance in this matter.

In Spain to date, and excluding the family, there is no established tradition in the field of mediation, the first option to any dispute the courts. As an alternative to this approach, we find the arbitration, which has increasingly more popular, especially among large and multinational companies whose business or activity carries with it specific regulations and complex, requiring specific knowledge by anyone has to resolve a conflict in the area concerned.

Therefore, in our country the way ahead is still long to reach the goal to enact the directive, not by the introduction of the means to consider mediation much a reality in all areas, but because it will be necessary from the Administration, continuing firms and persons covered by this process, it acquires the knowledge that this is a really effective mechanism impartial and competent to solve conflicts.

In this regard, it must be remembered that both the judicial process, such as arbitration, not always offer advantages, and other problems that result in delays in obtaining judgments, cost of procedures, etc ... Ultimately

, at this juncture, it is not only advisable, but necessary a third way of conflict resolution ("Mediation"), which may precede any of the other two alluded to ("Jurisdiction" and "Arbitration"), allowing parties to reach settlements, with consequent commercial benefits of time and cost this would entail.

However, in the end, as in most cases, we should expect that this mechanism is put in place to assess and evaluate the results it delivers in practice. But without doubt, that the target deserves the joint effort of all fixed estamentos.objetivo deserves the joint effort of all levels.
